Welcome to Zeltronic! The terms "we," "us," and "our" refer to Zeltronic, a trade name of 9437-7827 Québec Inc. (NEQ 1176373687), a company registered in Québec, Canada.
Zeltronic operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Zeltronic is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights, including warranty and liability provisions.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.
Important — your consumer rights. Nothing in these Terms limits, excludes, or modifies any right or remedy you may have under Québec's Consumer Protection Act, the federal Competition Act, or any other mandatory consumer-protection legislation applicable to you. Where any provision of these Terms conflicts with such legislation, that legislation prevails.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your province or territory of residence, and that you consent to any minor dependents using the Services on devices you own or manage.
To use the Services — including browsing our store or purchasing products — you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent that all information you provide is correct, current, and complete.
You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or license your account to another person.
SECTION 2 — OUR PRODUCTS
We make every effort to represent our products accurately. However, colours and product appearance may differ from how they appear on your screen depending on your device and its settings.
Product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product and to limit the quantities of any product we offer to any person or region, on a case-by-case basis.
This section does not affect the legal warranty of quality and the warranty of conformity to the description that apply to consumer goods under Québec's Consumer Protection Act and the Civil Code of Québec.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. Zeltronic reserves the right to accept or decline your order at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before an order is accepted.
Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted. If we do not accept, change, or cancel an order, we will attempt to notify you using the email, billing address, or phone number provided at the time of the order.
Your purchases are subject to return or exchange in accordance with our Return & Refund Policy.
Our products are offered for personal or household use, and not for commercial resale or export.
SECTION 4 — PRICES AND BILLING
All prices are in Canadian dollars (CAD). Prices, discounts, and promotions may change without notice. The price charged will be the price in effect when your order is placed, as set out in your order confirmation email.
Unless expressly stated otherwise, posted prices do not include applicable taxes (GST/QST and any provincial sales tax), shipping, or handling. Because we ship from within Canada, no customs or import duties apply to Canadian orders.
Promotions may be governed by their own terms; where those terms conflict with these Terms, the promotion terms govern.
You agree to provide current, complete, and accurate purchase, payment, and account information, and to update it promptly so we can complete your transactions and contact you as needed.
You represent that (i) the payment information you provide is true and complete, (ii) you are authorized to use the payment method, and (iii) you will pay all charges incurred at the posted prices, including shipping and applicable taxes.
SECTION 5 — SHIPPING AND DELIVERY
Delivery times are estimates and are not guaranteed. We are not responsible for delays caused by shipping carriers or events outside our reasonable control.
Please see our Shipping Policy for delivery estimates, shipping rates, and free-shipping thresholds. This section does not limit any rights you may have under applicable consumer-protection legislation if your order is not delivered.
SECTION 6 — INTELLECTUAL PROPERTY
Our Services — including all trademarks, brands, text, displays, images, graphics, product reviews, video, audio, and the design, selection, and arrangement thereof — are owned by 9437-7827 Québec Inc. (operating as Zeltronic), its affiliates, or its licensors, and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you a licence under any patent, trademark, copyright, or other intellectual property of Zeltronic, Shopify, or any third party. All rights not expressly granted are reserved.
Zeltronic's name, logo, product and service names, designs, and slogans are trademarks of 9437-7827 Québec Inc. or its licensors, and may not be used without our prior written permission. Shopify's name, logo, and marks are trademarks of Shopify. All other marks appearing on the Services belong to their respective owners.
SECTION 7 — OPTIONAL TOOLS
You may be given access to third-party tools through the Services, which we neither monitor nor control.
Such tools are provided "as is" and "as available," without endorsement. Your use of any optional third-party tool is at your own risk, and you should review the terms under which the relevant third-party provider offers it.
New features and tools released in the future will also form part of the Services and be subject to these Terms.
SECTION 8 — THIRD-PARTY LINKS
The Services may contain links to websites operated by third parties. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you leave the Services to access them, you do so at your own risk.
Please review the third party's policies before engaging in any transaction with them. Complaints or questions regarding third-party products and services should be directed to that third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Zeltronic is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Zeltronic (9437-7827 Québec Inc.). By using the Services, you acknowledge that Shopify is not responsible for any aspect of any sale between you and Zeltronic, including any injury, damage, or loss resulting from purchased products and services. You release Shopify and its affiliates from claims arising from or related to your purchases and transactions with Zeltronic.
SECTION 10 — PRIVACY
All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's Privacy Policy (https://privacy.shopify.com/en). By using the Services, you acknowledge that you have read these policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. Information you submit may be transmitted to Shopify and to third parties located outside Québec and Canada. See our Privacy Policy for details.
SECTION 11 — REVIEWS AND FEEDBACK
If you submit any ideas, suggestions, feedback, reviews, proposals, or other content ("Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, and display that Feedback in any medium, including for commercial purposes.
You represent that: (i) you own or have all necessary rights to your Feedback; (ii) you have disclosed any compensation or incentive you received in connection with submitting it, as required by the Competition Act; and (iii) your Feedback complies with these Terms. Reviews must reflect your genuine experience.
We are under no obligation to keep Feedback confidential, to compensate you for it, or to respond to it. We may — but are not required to — monitor, edit, or remove Feedback we consider unlawful, offensive, defamatory, obscene, or otherwise objectionable.
Your Feedback must not violate any third-party rights (including copyright, trademark, privacy, or personality rights), contain unlawful or abusive content, or contain malware. You may not use a false email address or impersonate another person. You are solely responsible for your Feedback and its accuracy.
SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct such errors and to change or update information, or cancel affected orders, at any time without prior notice (including after you have submitted an order). If we cancel an order for this reason, you will receive a full refund.
SECTION 13 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, defame, or harm any person; (e) to transmit false or misleading information; (f) to send spam, chain letters, or unsolicited promotional material; (g) to impersonate any person or entity; or (h) to engage in conduct that restricts anyone's use of the Services or may expose Zeltronic, Shopify, or other users to liability.
You also agree not to: (a) upload or transmit viruses or malicious code; (b) reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services; (c) collect or track the personal information of others; (d) phish or pretext the Services; (e) use any robot, spider, scraper, data-extraction tool, or automated means to access the Services; or (f) bypass or circumvent security or authorization measures.
We may suspend, disable, or terminate your account if we determine that you have violated these Terms.
SECTION 14 — AUTOMATED AGENTS
14.1 This section applies if you use, enable, or cause the deployment of an Agent to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of a person or entity without direct supervision.
14.2 No Agent may access or interact with the Services unless it identifies itself and operates in accordance with section 14.4. No Agent may access the Services if we have requested that it refrain from doing so.
14.3 We may limit, including by technical measures, whether and how any Agent accesses the Services.
14.4 Agents must: (i) identify themselves in all HTTP/HTTPS requests by including "Agent/[agent name]" in the user agent string; (ii) not conceal that access is from an Agent, including by mimicking human behaviour or circumventing CAPTCHAs; (iii) respond truthfully to any request to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit, or control how Agents access the Services.
SECTION 15 — TERMINATION
We may terminate this agreement or your access to the Services at any time, and you will remain liable for all amounts due up to the date of termination.
The following sections survive termination: Intellectual Property, Reviews and Feedback, Termination, Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy, and any other provision that by its nature should survive.
SECTION 16 — WARRANTIES
Your legal warranties are protected. Products sold to consumers in Québec are covered by the legal warranty of quality under the Consumer Protection Act and the Civil Code of Québec, which cannot be excluded. Many of our products also carry a manufacturer's warranty.
Subject to the above, and to the fullest extent permitted by applicable law, the Services and any information presented on them are provided for general information purposes on an "as is" and "as available" basis. We do not warrant that your use of the Services will be uninterrupted, timely, secure, or error-free, or that the information on the Services is complete or free of error.
Nothing in this section excludes or limits any warranty, condition, or remedy that cannot be excluded or limited under applicable consumer-protection law.
SECTION 17 — LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, and subject to your rights under Québec's Consumer Protection Act and other mandatory consumer-protection legislation, Zeltronic (9437-7827 Québec Inc.), its directors, officers, employees, affiliates, agents, contractors, service providers and licensors — and those of Shopify — shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of profits, revenue, savings, or data, arising from your use of the Services or of any product purchased through them.
Nothing in these Terms excludes or limits our liability where such exclusion or limitation is prohibited by law, including liability for bodily injury, gross negligence, or intentional fault, or any liability we may have under the Consumer Protection Act.
SECTION 18 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Zeltronic, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims — including reasonable legal fees — payable to a third party arising out of (1) your breach of these Terms, (2) your violation of any law or third-party right, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim. We may control the defence and settlement of such a claim at your expense, but will not settle a claim imposing non-monetary obligations on you without your consent (not to be unreasonably withheld). You agree to cooperate in the defence of indemnified claims.
SECTION 19 — SEVERABILITY
If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed. This does not affect the validity of the remaining provisions.
SECTION 20 — WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
These Terms, together with any policies posted on this site, constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements or communications.
Any ambiguity in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 21 — ASSIGNMENT
You may not delegate, transfer, or assign these Terms or any of your rights or obligations under them without our prior written consent; any such attempt is void. We may transfer or assign these Terms and our rights and obligations without notice to you.
SECTION 22 — GOVERNING LAW AND JURISDICTION
These Terms of Service, and any separate agreements under which we provide you Services, are governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the Services shall be brought before the competent courts of the judicial district of Montréal, Québec, Canada, and you and Zeltronic consent to their jurisdiction — without limiting any right you may have as a consumer to bring proceedings in the district of your own domicile, as provided by Québec law.
SECTION 23 — LANGUAGE
The parties confirm that it is their wish that these Terms, as well as all documents relating hereto, be drawn up in English.

Headings are included for convenience only and do not limit or affect these Terms.
SECTION 25 — CHANGES TO THESE TERMS
You can review the most current version of these Terms at any time on this page.
We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. We will notify you of material changes in accordance with applicable law, and such changes will take effect on the date specified in the notice. Your continued use of the Services following the posting of changes constitutes acceptance of those changes.
